Terms of Service

These terms form an agreement between you and Reachmark. By creating an account or using the service you accept them. If you do not accept them, do not use the service.
1. The service
Reachmark provides business-discovery, outreach, networking (digital cards, events, lead capture, bookings), and client-management tools, including AI-assisted drafting and suggestions. Features vary by plan; some are free and sophisticated ones require a paid tier.
2. Eligibility and accounts
- You must be at least 18 years old.
- Client accounts are for tracking your own projects, invoices, and reviews. The studio workspace is for the owner/operator.
- You are responsible for keeping your credentials confidential and for activity under your account. Notify us promptly of unauthorised use.
3. Plans and billing
- Plans: Free, Starter, and Pro, as described on /pricing. Paid plans run in 30-day terms.
- Payments are processed by Paystack; prices are shown in USD and NGN. We never see or store your card details.
- Fees are non-refundable except where required by law. Downgrading takes effect at the end of the current term; gated features lock again when a plan expires.
4. Acceptable use
You agree not to:
- Send outreach without a genuine lawful basis — every send in the product requires your explicit approval and a stated contact basis; abuse of this (spam) may lead to suspension.
- Mail anyone who has opted out, attempt to bypass suppression, or harvest addresses unlawfully.
- Upload unlawful, infringing, or malicious content; probe, overload, or disrupt the service; attempt to access other users' data.
- Resell or share workspace access except as the service expressly permits.
5. AI-assisted content
Drafts, scores, card-scan readings, and other AI outputs are suggestions, not facts. They may be wrong. You must review everything before sending, publishing, or relying on it. AI features do not create legal, financial, or professional advice.
6. Your content
You keep ownership of content you upload or create (leads, cards, messages, photos). You grant us a licence to store, process, and display it solely to operate and improve the service for you, including pushing lead events to webhook URLs you configure.
7. Our intellectual property
The Reachmark name, logo, design, templates, and software are ours (or our licensors'). Nothing here transfers ownership to you. Do not copy, reverse-engineer, or misrepresent the service.
8. Availability and disclaimer
We aim for reliable service but provide it “as is” and “as available”, without warranties of any kind — including fitness for a particular purpose, uninterrupted availability, or specific business results from outreach.
9. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising from the service is limited to the fees you paid in the 12 months before the claim (or ₦50,000 if you paid nothing). We are not liable for indirect, incidental, or consequential losses, including lost business or missed messages.
10. Termination
You may close your account at any time from the app. We may suspend or terminate accounts that breach these terms, abuse the service, or remain unpaid. On termination your right to use the service ends; mail-log and suppression records needed for compliance may be retained as described in the Privacy Policy.
11. Changes
We may update these terms; material changes will be posted here with a new effective date. Continued use after changes take effect constitutes acceptance.
12. Governing law
These terms are governed by the laws of Lagos State, Nigeria. Disputes will first be attempted in good-faith negotiation for 30 days, then submitted to the courts of Lagos State. (This is a starting point — have local counsel review it for your situation.)
